Procedures for Student Enrollment by Non-Parent

Residency: A student who lives in the home of a caregiving adult (who is other than a parent or legal guardian of the student) that is located within the boundaries of the Vista Unified School District is considered a resident of the District and may register for school (Education Code §48204).

Caregiver Authorization Affidavit: In order to register the student, the caregiving adult must execute a Caregiver's Authorization Affidavit. (Family Code §6552.) The District may verify the student's residence by reasonable means and/or require additional evidence that the caregiver lives at the address stated in the Caregiver's Authorization Affidavit.

Parent's Retain Rights, Unless Otherwise Specified: The Caregiver's Authorization Affidavit does not affect the rights of the parents or legal guardians regarding the care, custody and control of the student, and does not mean that the Caregiver has legal custody, has the right to access student records or to make educational and other decisions for the student. Unless other action is taken, the student's parents or legal guardians retain those rights and responsibilities.

Guardianship, Foster Parent Status, or Power of Attorney: If the student's parents/guardians desire that the Caregiver act on their behalf to access student records, make educational, medical and other decisions for the student, the parents/guardians should consult an attorney to determine whether it would be appropriate to make the Caregiver a foster parent or guardian of the student, or whether to grant the Caregiver a Power of Attorney to act on their behalf. A sample Power of Attorney form is attached. Whether this Power of Attorney form is appropriate depends on the facts and circumstances specific to your situation. For this reason, the District does not endorse its use in your situation or purport to give legal advice. The District recommends that any person considering granting a power of attorney first consult with an attorney, although it is not required.

If the natural parent or legal guardian of the student will not have day-to-day custody or control of the student, it is the practice of the Vista Unified School District that the Caregiver will obtain status as a foster parent, guardian or obtain a Power of Attorney.

CIF rules and Board Policies determine if the student meets athletic eligibility separate from these procedures.
